These Terms and Conditions (the “Terms”) apply to your use of expertlandsellers.com (the “Site”) and to the Expert Land Sellers text messaging program described in Section 9. Expert Land Sellers is a trade name of Diego & Partners Inc., based in Brooklyn, New York (“Expert Land Sellers,” “we,” or “us”). By using the Site or submitting a form on it, you agree to these Terms. If you do not agree, please do not use the Site.

1. What We Do

Expert Land Sellers is a real estate investment company. We make cash offers to property owners who want to sell, and we may buy properties directly. The Site is for general information only. It is not legal, tax, or financial advice, and you should speak with your own attorney or advisor about your situation.

2. Offers Are Not Binding Until Signed

Submitting a form, talking with us, or receiving an estimate or offer by phone, text, or email does not create a contract. No sale is binding on you or on us until a written purchase agreement is signed by both sides. We do not guarantee that we will make an offer, the amount of any offer, or any closing date.

3. Information You Give Us

When you submit a form, you confirm that the information you give is accurate, that you own the property or have authority to discuss selling it, and that the phone number and email address you provide belong to you or that you are authorized to use them. We handle your information as described in our Privacy Policy.

4. Using the Site

You agree to use the Site only for lawful purposes. Do not submit false information, submit a form for another person without their permission, try to disrupt the Site or gain unauthorized access to it, or use automated tools to collect Site content or submit forms.

5. Content and Ownership

The text, images, design, and other content on the Site belong to Expert Land Sellers or its licensors and are protected by law. You may view the Site and print pages for your own personal use. You may not copy, republish, or sell Site content without our written permission.

6. Links and Third Party Services

The Site may link to or rely on third party websites and services, such as video, mapping, and form tools. We do not control those services and are not responsible for their content or practices.

7. Disclaimers and Limitation of Liability

To the extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind. We do not promise that the Site will always be available or error free, or that its content is complete or current. To the extent permitted by law, Expert Land Sellers and Diego & Partners Inc. will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site, and our total liability for any claim related to the Site will not exceed $100. Nothing in these Terms limits any right you have that cannot be limited under applicable law.

8. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute related to the Site will be brought in the state or federal courts located in New York, and you consent to that venue.

9. Text Message (SMS) Program Terms

These terms apply to text messages sent by Expert Land Sellers. Please read them before you agree to receive texts.

  • Program: Expert Land Sellers text messages, sent by Expert Land Sellers (Diego & Partners Inc.).
  • What you will receive: Text messages about your property inquiry, such as replies to your questions, follow up about selling your property, information about a cash offer, and help scheduling a call or next steps. We do not use this program to send messages unrelated to your inquiry.
  • How you join: By checking the optional text message consent box on a form on this Site and submitting the form with your mobile number. You may also start a text conversation by texting us first, and we may reply to your messages.
  • Consent is optional: Agreeing to receive text messages is not a condition of submitting a form, receiving an offer, or selling your property. You can submit our forms without checking the box, and we may still contact you about your request by phone or email.
  • Message frequency: Message frequency varies based on your inquiry and your replies.
  • Costs: Message and data rates may apply, depending on your mobile plan. We do not charge you for the messages themselves.
  • Opt out: Reply STOP at any time. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. We will send one message confirming that you are opted out, and then no more texts unless you opt back in.

  • Opting back in: After you opt out, you can rejoin by submitting a form on the Site with the text message box checked, or by replying START to our number.
  • Your number: You must be the subscriber or an authorized user of the mobile number you provide. If you give up or change your number, let us know so that messages do not go to someone else.
  • Carriers: Mobile carriers are not liable for delayed or undelivered messages, and delivery is not guaranteed.
  • Your mobile information: We do not sell, rent, or share your mobile number or text message consent information with third parties or affiliates for their marketing or promotional purposes. See the Text Messaging section of our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with its last updated date. If you keep using the Site after a change, you accept the updated Terms.
